Divorce
Divorce is the legal process ending a marriage. At the end of your divorce proceedings the Decree Absolute is issued ending your marriage. We refer you to the information sheet below headed Getting Divorced, this gives full details of the procedure. We also refer you to our fixed fee package in relation to this when considering the costs involved.
You also need to be aware from the outset that this legal process will not deal with the division of your assets, income or pensions nor will it deal with any arrangements for your children. In relation to Children Matters we refer you to the section headed Child Matters for details.
In order to obtain a financial settlement you will need to instruct us to represent you in this regard. This legal process is known as Ancillary Relief. We refer you to the information sheet below and on the home page which will give you more information about the procedure. We also refer you to our fixed fee package in relation to this with regard to costs.
We also refer to a Separtation Deed or Agreement below. This is an alternative to Divorce but as indicated you will not be Divorced via this option. We refer you to our information sheet in relation to this and our fixed fee package as to costs.

Divorce (uncontested)

The majority of divorces proceed on an uncontested basis. This means that both you and your spouse give consent to the marriage being ended. An uncontested divorce is dealt with by the court without the need for any court hearings and is therefore a paper process.
Separation Deed Package

This package is based upon the fact that you and your spouse or partner have agreed the basic principles of your separation i.e. how your assets are to be dealt with. Without wishing to divorce immediately.
Ancillary Relief (Matrimonial Financial Matters)

In order to deal with your matrimonial finances, upon divorce, you will need advice and assistance in relation to Ancillary Relief.
A financial settlement can be reached voluntarily without the need for a contested court application. We have a number of options to offer you regarding the process of obtaining a financial settlement, making a court application or simply helping you to formalise an agreement you have agreed direct with your spouse.
